The first charge was for careless and inconsiderate driving, a violation of Section 3 of the Road Traffic Act 683 (2004), amended by Act 761 of 2008, and was fined GHC1,200. Mr. Dzidotor will serve a jail term of 20-months should he default in paying.
Unauthorized stopping as a second charge incurred a fine of GHC240, or five-months jail term as it violates Section 19 of Act 683 (2004), amended by Act 761 of 2008.
He was slapped with a six-month sentence with hard labour after pleading guilty to the third charge, causing unlawful damage, which contravenes Section 172b of the Criminal Offences Act 2960.
However, he pleaded not guilty to the fourth charge of failing to produce a driver’s license contrary to regulation 47(2) of LI 21(80) as he claimed his license was within the damaged vehicle.
Abel Dzidotor was arrested by the police after preliminary investigations established that he left the Hyundai truck with registration number GS 9018-20 unattended on the rail track leading to the collision with the newly procured DMU train from Poland during a test run.
