Court Grants NLC Permission to Serve Injunction on Striking Nurses and Midwives via WhatsApp

In a landmark move, the court has granted the National Labour Commission (NLC) the legal green light to serve an injunction notice to striking members of the Ghana Registered Nurses and Midwives Association (GRNMA) through WhatsApp.

The decision comes amid a nationwide strike action by nurses and midwives demanding better conditions of service and unpaid allowances. The NLC, seeking to halt the industrial action, filed for an injunction and requested permission to serve the notice electronically due to challenges in physically locating the union leaders.

The court ruled that under current circumstances, WhatsApp service is valid and binding, given the urgency of the matter and the accessibility of the platform to the affected parties.

Key Developments:

The GRNMA declared a strike last week over stalled negotiations.

Hospitals and clinics across the country have reported reduced staff presence.

The Ministry of Health has urged the health workers to return to post while negotiations continue.

Legal analysts suggest this ruling may set a precedent for the digital delivery of legal documents in urgent labor and civil cases in Ghana.

As of this report, the GRNMA leadership has acknowledged receipt of the injunction via WhatsApp but has yet to make an official statement on compliance.
